Trash Ordinance

CONCERNING RESIDENTS WITHIN THE CITY LIMITS OF ROGERS
Ordinance No. #09-92 was passed November 10, 2009. It states:

Section 1:  That all solid waste refuse containers for residential units shall be placed at the curbside no later than 6:30 a.m. on the scheduled pickup day and no earlier than 6:30 a.m. on the day prior to the scheduled pickup day.  The City's solid waste disposal provider, shall not be obligated or held responsible for collection of refuse not placed at curbside in accordance with this subsection.  Modifications to the collection schedule caused by weather-related phenomena or holidays shall not constitute grounds for violation of this subsection.

Chapter 46 Section 23  Residences serviced.

(a) All residents of the City of Rogers shall be required to subscribe to the solid waste services offered under this article. Those residents connected to the city water supply shall be billed for the services by Rogers Water Utilities. Those residents not connected to the city water supply shall contract individually with the city's solid waste contractor for the provision of solid waste disposal; however, for purposes of this section, multifamily residential units as defined by the zoning ordinance shall be considered commercial establishments and accordingly excluded under this section. The following exceptions shall apply:

Those residents who are not connected to the city water supply and who can show proof that they are paying for removal of their trash off-site by a legal contractor, may make application to Inland Service Corporation for an exemption. If denied, the resident may then petition the public works committee of the Rogers City Council for said exemption. Said petition must be filed within 30 days from the date of denial by Inland Service Corporation, and the decision of the public works committee shall be final.

(b) Those residents required by subsection (a) above, to contract with Inland Service Corporation for solid waste disposal, shall do so within 30 days of the passage of this section.
